Tr\u00e1fico de pessoas \u00e9 \u201co recrutamento, transporte, transfer\u00eancia, abrigo ou recebimento de pessoas por meio de amea\u00e7a, for\u00e7a ou outras formas de coer\u00e7\u00e3o, sequestro, fraude, engano, abuso de poder, uma posi\u00e7\u00e3o vulner\u00e1vel de dar ou receber pagamentos ou benef\u00edcios para obter o consentimento de uma pessoa ter controle sobre eles, para fins de explora\u00e7\u00e3o\u201d. Essa defini\u00e7\u00e3o pode ser encontrada no Protocolo de Preven\u00e7\u00e3o, Repress\u00e3o e Puni\u00e7\u00e3o ao Tr\u00e1fico de Pessoas, Especialmente Mulheres e Crian\u00e7as, complementar \u00e0 Conven\u00e7\u00e3o das Na\u00e7\u00f5es Unidas contra o Crime Organizado Transnacional, tamb\u00e9m conhecida como Conven\u00e7\u00e3o de Palermo.<\/p>

O Contrabando de Migrantes \u00e9 um crime que envolve a obten\u00e7\u00e3o de benef\u00edcio financeiro ou material da entrada ilegal de uma pessoa em um Estado em que essa pessoa n\u00e3o \u00e9 nacional ou residente. O contrabando de migrantes afeta quase todos os pa\u00edses do mundo. Isso prejudica a integridade de pa\u00edses e comunidades e custa milhares de vidas a cada ano. O contrabando de migrantes, mesmo em condi\u00e7\u00f5es perigosas e degradantes, envolve o conhecimento e o consentimento da pessoa contrabandeada quanto ao ato criminoso. No tr\u00e1fico de pessoas, o consentimento da v\u00edtima do tr\u00e1fico \u00e9 irrelevante para que a a\u00e7\u00e3o seja caracterizada como tr\u00e1fico ou explora\u00e7\u00e3o de seres humanos, uma vez que geralmente \u00e9 obtido com insucesso.<\/p>

Explora\u00e7\u00e3o<\/h4>

O contrabando termina com a chegada do migrante ao seu destino, enquanto o tr\u00e1fico de pessoas envolve, ap\u00f3s a chegada, a explora\u00e7\u00e3o da v\u00edtima pelos traficantes, com o objetivo de obter algum benef\u00edcio ou lucro, atrav\u00e9s da explora\u00e7\u00e3o. Do ponto de vista pr\u00e1tico, as v\u00edtimas do tr\u00e1fico de pessoas tendem a ser mais severamente afetadas e precisam de maior prote\u00e7\u00e3o.<\/p>
